86. Family present from 1-5, 7-10 P. M. 15117 REGAN DISMISSES CONTEST OF WILL OF J. A.

WILSON. A contest over the will of James A. Wilson, maintenance man, who died Nov. 27, 1963, was dismissed this afternoon by Surrogate William J. Regan, He ruled there was insufficient evidence of alleged "undue influence" to submit to the jury, which had been drawn and heard the testimony.

The surrogate's ruling admitted to probate the will naming the deceased's widow, Theonia, 139 Northland as sole beneficiary. Objections had been filed by Vincent Wilson, 573 Humboldt the eldest of five children of a prior marriage, who would have shared in the estate if the will had been ruled invalid. Mrs. Wilson has a 3-year-old child who was represented by special guardian Joseph J. May, who urged that the will be sustained.

The will disposed of a $15,000 estate which the attorney, liam H. Hepp, representing the widow, said consisted chiefly of the Northland Ave. residence and another dwelling at 118 E. Ferry St. In dismissing the jury, Surrogate Regan noted that the calendar of the Surrogate's Court allows for an immediate trial of will contests.

The objections were filed this month. KEEPING MOUTH SHUT GOT HIM INTO TROUBLE You can get in trouble, even when you keep your mouth shut, according to Carl Shelton, 35, in City Court today. Shelton, through his attorney, Richard D. Grisanti, brought a motion to suppress any evidence seized by police with his arrest on a narcotics charge Nov. 1 on the grounds his constitutional rights were violated.

The defendant said he was standing on the corner, with his closed, when a police car cruised by. The policemen recognized him, Shelton added, and they leaped out and told him he was under arrest and to get into the police car. Still with his lips sealed, Shelton claimed that police "jumped" on him and forced him to open his mouth, revealing 12 capsules containing heroin. "It was impossible to see anything in the defendant's mouth until after the arrest and until said police officers choked said bag containing 12 capsules of heroin out of the defendant's mouth," Mr. Grisanti claimed.

Judge Michael E. Zimmer set the matter down for arguments on the law Jan. 2 23. AGING PROCESS ENDS WITH BANG ATLANTA, Jan. 15 (P) An experiment in aging whisky over with a bang, but went police advise against it.

Officers said Emory A. Blackwell, 57, was visiting his brother's apartment Tuesday and cided to test an idea for aging whisky. They said he placed a keg filled with whisky into a lard can containing water and placed the can on a stove. Police said the water evidently boiled out of the can and the whisky exploded. The brother, Leland R.

Blackwell, 43, was hospitalized with first-degree burns. Emory Blackwell was charged with being drunk and disorderly conduct. Fined $25 for Assault Sammy Lee West, 24, of 585 Michigan was fined $25 today by City Judge Sebastian J. Bellomo on a conviction of thirdassault. Arthur Dykes, of degree the same address, charged that West came into his room Nov.

TWO U.S. PILOTS FEARED DEAD IN VIET NAM CRASH SAIGON, South Viet Nam, Jan. 15 (UPI)-Two U. S. Air Force pilots and a Vietnamese are feared dead in the crash of their B-26 bomber, apparently downed by Communist fire, a U.

S. military spokesman said today. A search began at dawn for the Vietnamese Air Force plane's crew 40 miles northwest of Saigon. The plane crashed just before dark Tuesday night and rescue workers could not reach the site because of the darkness and heavy Communist fire. "There is no evidence of the spokesman said.

"The victims will not be identified until relatives are notified." Their deaths, if confirmed, would bring to 167 the number of U. S. servicemen killed in South Viet Nam in the three years since large-scale U. S. aid began here.
